Terms of Use

ReadLab is a product of Gymspiratie B.V., registered in the Netherlands. In these Terms of Use, Gymspiratie B.V. is referred to as 'ReadLab', 'we' or 'us'.

These Terms of Use apply to all use of the ReadLab app and associated services. By downloading the app, creating an account, or using the app, you agree to these Terms.

ReadLab is intended exclusively for use by or on behalf of primary school-age children (ages 4 through 13), under the supervision of a parent, guardian, or qualified education professional.

3.1 Parent and Guardian Accounts

Only persons aged 18 or older may create an account in ReadLab. By creating an account, you confirm that you are 18 years of age or older. Children do not have their own accounts; they use the app through the parent or guardian's account.

3.2 Child Profiles

A maximum of four (4) child profiles can be created within a parent account. Each profile is linked to the parent account. The parent or guardian is responsible for the child's use of the app.

ReadLab uses a PIN system to protect parent account settings. The parent or guardian is responsible for keeping this PIN confidential.

3.3 Guest Use

ReadLab can be used without an account in guest mode. In guest mode, no personal data is stored: the age indication and progress are saved exclusively on the device and are never sent to our servers. Guest use is limited to a maximum of 10 exercises. By using the app as a guest, you also agree to these Terms of Use.

4.1 Free and Pro Version

ReadLab offers a free basic version and a paid Pro subscription. The free version provides access to a limited set of exercises. Pro gives unlimited access to all reading exercises, levels, and progress overviews. One subscription covers up to four child profiles within the same parent account.

4.2 Purchases via App Store and Google Play

Subscriptions are processed through the Apple App Store or Google Play Store. Payment terms, billing, renewal, and refunds fall entirely under the policies of Apple or Google respectively. ReadLab does not have access to your payment details and does not process payments directly.

4.3 Automatic Renewal and Trial Period

ReadLab Pro subscriptions begin with a free trial period of fourteen (14) days. After the trial period ends, the subscription automatically converts to a paid subscription, unless you cancel before the end of the trial period through your App Store or Google Play account settings.

Paid subscriptions renew automatically unless you cancel before the end of the current subscription period. Subscription management is handled through your App Store or Google Play account settings.

5.1 Permitted Use

ReadLab is intended for educational use by children aged 4 through 13, exclusively in a private or school environment. You may use the app for personal, non-commercial purposes.

5.2 Prohibited Use

The following actions are not permitted:

• copying, modifying, distributing, or reverse-engineering the app or any part of it;
• using the app for commercial purposes without prior written consent from Gymspiratie B.V.;
• using the app in a manner that harms children or that violates applicable laws and regulations;
• providing false information when creating an account;
• using the app to gain unauthorized access to systems or data.

Gymspiratie B.V. attaches great importance to user privacy, and in particular to the privacy of children. Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy legislation.

The ReadLab app only processes data that is necessary for the functioning of the service. We do not sell personal data to third parties and do not place advertisements in the app.

For the functioning of the service, ReadLab uses the following third-party processors: Supabase Inc. (authentication and progress storage, based in the US, under EU Standard Contractual Clauses) and RevenueCat Inc. (subscription management, based in the US, under EU Standard Contractual Clauses). Personal data may therefore be transferred outside the European Economic Area.

When creating a child profile, the parent or guardian explicitly consents to the processing of the child's data, in accordance with Article 8 of the GDPR. This consent is digitally recorded with a timestamp. The parent or guardian may withdraw consent at any time by deleting the child profile.

ReadLab is offered in the Kids Category of the Apple App Store. We comply with the requirements that Apple and Google set for apps aimed at children, including restrictions on data collection and the use of third-party SDKs.

All rights to the ReadLab app, including but not limited to texts, exercises, illustrations, software, brand names and logos, are owned by Gymspiratie B.V. or used under license. Nothing in these Terms grants you any rights to these proprietary rights.

You may not reproduce, publish, or commercially exploit content from the app without the express written consent of Gymspiratie B.V.

8.1 Availability

We strive for optimal availability of the app but cannot guarantee uninterrupted access. We are not liable for any damage resulting from temporary unavailability or technical malfunctions.

8.2 Limitation of Liability

The liability of Gymspiratie B.V. is limited to direct damages that are the direct result of a demonstrable shortcoming by ReadLab. Gymspiratie B.V. is not liable for indirect damages, consequential damages, or damages resulting from improper use of the app.

In no event shall the total liability of Gymspiratie B.V. exceed the amount paid by the user for a ReadLab subscription in the twelve months prior to the damaging event, with a minimum of EUR 25. For free users, the maximum liability is likewise EUR 25.

Gymspiratie B.V. reserves the right to modify the ReadLab app and these Terms of Use at any time. We will notify you of material changes through the app or by email.

For material changes that restrict consumer rights, you will receive at least thirty (30) days' advance notice. During this period, you may cancel your subscription free of charge, effective from the date the changes take effect. Continued use of the app after the effective date constitutes your acceptance of the updated Terms.

You may delete your account at any time through the account settings in the app, or by contacting support@readlab.app. After termination, your data will be processed in accordance with our Privacy Policy.

Gymspiratie B.V. may suspend or delete an account in the event of a violation of these Terms, abuse, or fraudulent conduct.

These Terms of Use and the use of ReadLab are governed by Dutch law. Disputes are preferably resolved by mutual agreement. If that is not possible, the courts in the Netherlands have jurisdiction, with the Amsterdam court as the competent court, unless the law designates another court.
